Has the following been addressed by anyone?
Before the highway construction began on Woodman, the left side of the road (across from Oasis) was becoming cluttered with development signs, yard sales, dog sales, etc. I noticed Banning Lewis still has a sign up, but what about those other obstructive signs on Meridan and Woodman. Do they have the permit to post those signs, what can we do about them?
Poor Safeway customers, etc -- they have a regular car lot and pet store going. There should be a fee or a law should prohibit this. Maybe a fee would be great and we could make sure it goes to the fire department or our new library.
Is there a county law prohibiting signs, yard sales and dogs/cats being sold without permits?
Instead of creating an eye-sore in our community, why don't those folks junk up their areas with signs!

She has made a good point.
There must be a law against this sort of thing, maybe one could find out through the Sheriff's office.

| Kathy Hare Submitted On: 02-26-2008 | | The county does require permits for signs over a certain size. But most of the "New Home" signs out there do not need a permit. I think the quickest way to clean up the mess is to go directly to the builders or developers and let them know these signs have created an eyesore in our community.
As for the sale of pets in the Safeway parking lot, Kathy Wallace, reporter for the New Falcon Herald, has an article coming out on Saturday, March 1, which addresses that issue. I hope it answers some of your questions.

I wrote an article for The New Falcon Herald about the legality of people selling puppies in parking lots and by the side of the road. The article will be in the 3/1 issue.
There is no county ordinance against this despicable practice.
There is PACFA (Pet Animal Care Facilities Act), a Colorado law. As best as I could find out by calling the PACFA program office, if you
1) sell more than two litters a year, you need a PACFA license.
2) sell more than 24 puppies a year, you need a PACFA license.
3) sell puppies purchased for resale, regardless of number, you need a PACFA license.
I highly doubt these people have PACFA licenses. I suspect they are buying puppies from puppy mills.
I think we need to gather evidence over time, given the way the PACFA law is written. I want to take pictures of the people selling puppies and their vehicle license plate numbers. Unfortunately, I don't live in Falcon (I live in Peyton).
I am asking that any one who sees puppies being sold take pictures of the seller and the seller's vehicle if they can and send them to me, or send me an e-mail INSTANTLY so I can drive into Falcon and take pictures. Or call me at 719-749-2905 x52 (home) or my cell phone (719-494-3419).
Once we've got some pictures and traceable vehicle license plate numbers, we can submit the information to the PACFA office. I have heard that the PACFA inspector has cited people selling puppies in the past.
In my opinion, PACFA is not strong enough legislation to really solve the problem, and the PACFA program office is seriously understaffed, with just three inspectors for all of Colorado and its 1,750 licensed facilities.
Unfortunately, the office is administered by a manager who thinks three inspectors is just fine.
State rep Marsha Looper (marshalooper@gmail.com) is interested in this issue, so I would suggest that you send her an e-mail. County commissioner Amy Lathen (amylathen@elpasoco.com) has said she is interested in forming a citizens advisory committee on animal control, so sending her an e-mail wouldn't hurt, either. Maybe we can get a county ordinance.

| Lisa Rasmussen Submitted On: 05-12-2008 | | I saw the article in the New Falcon Harold this week to contact you to get involved with stopping the sale of puppies at the Safeway parking lot (and roadsides.) I am very concerned about the puppy's welfare and humane treatment, and that they may come from local puppy mills.
Prior to the article, I have contacted the HSUS (Humane Society of the United States, Colorado Office) alerting them to the Safeway puppy sales and possible puppy mill presence here in Falcon. I know the HSUS has an anti-puppy mill campaign, and from a HSUS Grassroots meeting I went too last month, the Colorado office encourages people to alert them to any suspicious puppy sale activity in the state. I hope my letter to them was helpful.
If there is any other way I can help out on this issue please let me know. I would like to be put on the list of concerned Falcon residents for the puppies. |

You say you will not publish anonymous letters but you chose to publish "Saddened by Don's Demise" without a name, only Concerned Falcon Business Owner. You say it is because the business owner requested the name be withheld for fear of retribution by county government. Unless that person is breaking the law what type of retribution would there be and if they are breaking the law maybe they should find another way to get their opinion out. I would rather think that the person has an agenda and that is to put fear in the people of Falcon to get them on the band wagon for Incorporation. I would rather believe the person is more concerned about the loss of business. If the word got out that they were trying to start another Incorporation movement just a short year after it was soundly defeated. It was a bad idea a year ago and it is still a bad idea. |
